Defense Attorney Josh Kolsrud’s Comments on the “Honor Killing Trial” in Lacey Washington

Defense attorney Josh Kolsrud offered his insights on the ongoing "Honor Killing Trial" in which Ihsan and Zahraa Ali are accused of attempting to kill their daughter. Kolsrud’s analysis focused on the challenges the prosecution faces in proving intent, given the chaotic nature of the altercation and the judge’s ruling against mentioning "honor killing" or "arranged marriage."

 

Contradictions in Witness Testimony vs. Defense Narrative

Kolsrud highlighted the inconsistencies between the defense's opening statements and the eyewitness testimony. The defense claimed that Mrs. Ali was present to help her daughter and that the daughter herself told police she was "calm and collected." However, the eyewitnesses, including a bus driver and another woman, painted a different picture, describing the daughter as being in "dire straits" and "terrified," which contradicts the defense's narrative. Kolsrud noted that these consistent testimonies from multiple witnesses, who all perceived the daughter's life to be in danger, present a significant challenge for the defense.

 

Credibility of Eyewitness Josh Wagner

A key point of contention for Kolsrud was the credibility of witness Josh Wagner, who obtained a copy of the bus's video of the incident through a public records request. Kolsrud argued that this action undermines Wagner’s credibility and suggests a "confirmation bias," implying that Wagner's testimony might be influenced by his repeated viewing of the video rather than a spontaneous recollection of events. He believes the defense attorneys should have pressed this point more vigorously during cross-examination.

 

Kolsrud also discussed the defense's strategy of emphasizing the chaos of the situation to argue that Mr. Ali was reacting to multiple stimuli, including other students attacking him, rather than intentionally trying to harm his daughter. While acknowledging that the "melee" creates different interpretations from various witnesses, Kolsrud pointed out that both Wagner and the bus driver described Mr. Ali as "overreacting at the very least" by putting his daughter in a chokehold. The critical question for the jury, according to Kolsrud, will be whether a chokehold, in this context, constitutes attempted murder, especially since the prosecution cannot introduce evidence related to honor killings or arranged marriages to establish motive.
